Cookie Banners and the Law

Cookie Banners and the Law

Cookie banners exist because the Privacy and Electronic Communications Regulations (PECR), alongside the UK GDPR, require you to get consent before placing most cookies on a visitor's device.

This is general guidance on doing banners properly rather than ticking a box for appearance's sake.

What a Compliant Banner Does

  • Blocks non-essential cookies until the visitor agrees.
  • Offers a clear 'reject all' as easily as 'accept all'.
  • Explains the categories of cookies in plain terms.
  • Lets people change their mind later.

Essential vs Non-Essential Cookies

Cookies strictly necessary to deliver the service the visitor asked for — such as keeping items in a basket — do not need consent. Analytics, advertising and most third-party cookies do.

Common Mistakes

  1. Loading analytics before consent is given.
  2. Making 'accept' obvious but hiding 'reject'.
  3. Treating continued browsing as agreement.
  4. Forgetting to honour the visitor's choice site-wide.
